I think a judge would have to specifically rule it as such in a court, given that such an activity cannot be reasonable assumed by any person to be a direct cause or catalyst of someone's death, given its paranormal nature.
As far as I am aware, sending an image of SCP-096 could be analogous to hexing or otherwise cursing someone, which doesn't have any specific common law doctrine or statute law forbidding it, at least to the best of my knowledge.
While you certainly can possess malicious intent when sending the picture, any death that transpires from the act cannot be reasonably proven to be linked to the act itself, at least not without official investigation, which could be a messy (and possibly bloody) affair.
