End User License Agreement (EULA)

This End User License Agreement (hereinafter referred to as "EULA") is a legal agreement between you and KameWorks that sets out the terms and conditions for the use of the Software.
This license applies to the Software product and all related documentation (manuals, packaging), whether printed, file, downloaded or accessed online, as well as any updates or upgrades that replace or supplement the Software and are not distributed as separate licenses.
KameWorks only licenses the Software, and no intellectual property rights, title or ownership of the Software is transferred or assigned to you.
All rights not expressly granted to you by this EULA are retained by KameWorks.
By installing or using the Software, you agree that you have read this EULA and agree to be bound by the terms and conditions defined herein.
If you attempt to circumvent any technological protection measures used in connection with the Software, this EULA shall immediately cease to be in force.
If you do not agree to the terms of this EULA, you may not install or use the Software.
This Agreement shall be governed by and construed in accordance with the laws of Japan.
Any disputes arising in connection with this Agreement shall be submitted to the exclusive jurisdiction of the district court with jurisdiction over the location of the business.
Article 1 Disclaimer
KameWorks shall not be liable for any damages, whether direct or indirect, special, incidental or consequential, arising from the use or inability to use the Software.
This includes, but is not limited to, lost profits, damage to hardware or software, or work stoppage due to interruption or malfunction.
This in particular means that KameWorks' liability under this Agreement is excluded to the maximum extent permitted by law, regardless of tort or other legal theory.
Article 2 Restrictions
The following rights are not permitted;
(a) using the Software for commercial purposes, i.e., for the purpose of generating direct or indirect economic benefits;
(b) distributing, sublicensing, renting, leasing, or transferring the Software to third parties, except as expressly provided in this Agreement;
(c) installing, using, or granting access to the Software on a network, or simultaneously installing the Software on multiple computers or gaming devices;
(d) illegally using the Software or its functions, or circumventing technological protection measures intended to prevent copying;
(e) reverse engineering, decompiling, disassembling, or modifying the Software;
(f) removing or modifying trademarks, logos, or other notices contained in the Software.
However, video distribution for the purpose of earning advertising revenue is permitted only for individual users who comply with the following video distribution guidelines.
Video distribution guidelines
- Prohibit expressions that may lead people to believe that the poster is the developer
- Prohibit expressions that infringe on the rights of third parties
- Prohibit expressions that excessively include politics, religion, or specific beliefs
- Prohibit the sale of gameplay videos
- Prohibit It is prohibited to restrict video viewing itself
- Prohibit expressions that use materials extracted from works created by developers
- Prohibit posting and distribution of gameplay videos that modify works created by developers
- Prohibit posting of videos with low creativity
- Prohibit posting and distribution of videos that mainly consist of BGM, SE, and audio
- Prohibit posting and distribution of gameplay videos that interfere with the sale, provision, and operation of the developer
If you violate the provisions defined in "Restrictions", this EULA will terminate immediately without notice.
When this EULA is terminated, you must permanently uninstall and delete this Software and any copies thereof.
In that case, KameWorks has the right to pursue all rights granted to KameWorks within the scope of applicable general laws.
