END-USER LICENSE AGREEMENT (EULA) FOR ALIEN BOB
IMPORTANT - READ CAREFULLY: This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Ruinous Studios Ltd for the video game software titled "Alien Bob" (the "Game") which includes computer software and may include associated media, printed materials, and "online" or electronic documentation. By installing, copying, or otherwise using the Game, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Game.
1. LICENSE GRANT:
Subject to the terms of this EULA, Ruinous Studios Ltd grants you a limited, non-exclusive, non-transferable, and revocable license to install and use one copy of the Game on a single computer or gaming device solely for your personal, non-commercial entertainment use.
2. RESTRICTIONS:
You may not sublicense, sell, lease, rent, loan, distribute, or otherwise transfer the Game or any copy thereof to any third party. You may not reverse engineer, decompile, disassemble, or modify the Game in any way. You may not remove or alter any copyright, trademark, or other proprietary notices contained in the Game.
3. OWNERSHIP:
Ruinous Studios Ltd retains all right, title, and interest in and to the Game, including all intellectual property rights therein. This EULA does not convey to you any rights of ownership in or related to the Game.
4. TERMINATION:
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice from Ruinous Studios Ltd if you fail to comply with any term(s) of this EULA. Upon termination of this EULA, you must cease all use of the Game and destroy all copies of the Game in your possession or control.
5. DISCLAIMER OF WARRANTY:
THE GAME IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. THE ENTIRE RISK ARISING OUT OF THE USE OR PERFORMANCE OF THE GAME REMAINS WITH YOU.
6. LIMITATION OF LIABILITY:
IN NO EVENT SHALL RUINOUS STUDIOS LTD BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE GAME, EVEN IF RUINOUS STUDIOS LTD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
7. GOVERNING LAW:
This EULA shall be governed by and construed in accordance with the laws of The United Kingdom, excluding its conflicts of law rules.
8. ENTIRE AGREEMENT:
This EULA constitutes the entire agreement between you and Ruinous Studios Ltd concerning the Game and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings concerning the Game.
