This End User License Agreement (“Agreement”) is between you and Dreamlit inc. (“Dreamlit”) regarding the installation and use of video game software, files, documentation, updates and related services provided by Dreamlit (“Towers of Aghasba” or “the Game”). This Agreement is legally binding.
By accessing or using the Game, you agree to be bound by this Agreement. If you do not agree to this Agreement, you may not access or use the Game. Your installation and use of Towers of Aghasba shall be deemed as your acceptance of this Agreement and your consent to be bound by all the terms of this Agreement.
1. Limited License
Subject to this Agreement, Dreamlit grants you a non-exclusive, non-transferable and non-sublicensable right to use Towers of Aghasba and related services for your non-commercial gameplay. You have the right to run Towers of Aghasba on a personal console, computer, or device according to the design of Towers of Aghasba and enjoy the services provided by Dreamlit.
Without prior written consent from Dreamlit, you shall not reverse-engineer, decompile, copy, reproduce, republish, post, transmit, display, distribute, modify, translate, disassemble or create any derivative work from any of those materials or any other portion of the Game for for-profit and non-profit purposes.
2. Other Prohibitions
Without Dreamlit’s agreement in writing, or expressly set out in this Agreement, you shall not commercially exploit Towers of Aghasba in the forms of distributing, leasing, licensing, selling, renting, or otherwise transferring or assigning the Game or any copies of the Game. Additionally, you shall not remove, alter, or conceal any proprietary notice contained in the Game or encourage, assist or allow any third party to any of the foregoing.
3. Ownership and Declaration of Rights
Dreamlit owns the trademarks to the names and logos of Dreamlit, Dreamlit Games and Towers of Aghasba. None of which may be used without Dreamlit’s written consent. Dreamlit contains all rights to Towers of Aghasba and related services, including all computer code, titles, text, designs, images, artwork, animations, video, music, audio, sounds, themes, objects, characters, character names, stories, dialogue, concepts and trade-marks, the operational interfaces. Towers of Aghasba and the game content is protected by copyright law and by national and international laws, treaties and conventions.
You shall only obtain the right to use the Game. Any rights not explicitly granted to you in this Agreement are reserved by Dreamlit. You agree to refrain from creating any work of authorship based on the Towers of Aghasba or its game content.
4. Updates and Third-Party Platforms
Dreamlit reserves the right to provide or deploy patches to update, upgrade, or modify Towers of Aghasba with the intent to improve the overall game experience, stability, functionality, performance, and/or security of the Game.
When using Towers of Aghasba and services provided by Dreamlit, you may need to log in to third-party platforms outside of Dreamlit's direct control. In such cases, you must comply with the rules and terms of these Third-party Platforms. Dreamlit assumes no responsibility for the Services or content provided by Third-party Platforms.
5. Privacy and Personal Information Protection
Dreamlit shall comply with any and all relevant laws and regulations to protect the security of your personal information, including real names, contact information and other details provided during account creation. You hereby consent to the collection, use and disclosure of your personal information to the extent necessary or desirable for us to communicate with you, and monitor your compliance with this Agreement. Dreamlit shall not sell your personal information to third parties. If you are suspected of fraudulent or other criminal activities, Dreamlit may disclose your personal information to the police or other authorities. Otherwise, Dreamlit will not disclose your personal information except as permitted or required by law.
You acknowledge and agree that Dreamlit has the right to provide personal information to relevant entities under the following circumstances:
a) Necessary to fulfil legal obligations in case of emergency situations to protect the life, health, and property of you or others.
b) Required by judicial or administrative authorities following statutory procedures.
c) You authorise Dreamlit to disclose or use said information.
d) Necessary for Dreamlit to bring a lawsuit or arbitration against you to protect its lawful rights and interests.
6. Your Responsibilities
You are solely responsible for obtaining and maintaining the device or devices (gaming consoles, computers, mobile smart devices, tablets, etc.) required for installing and using Towers of Aghasba and services provided by Dreamlit at your own expense. Dreamlit does not guarantee that Towers of Aghasba will not conflict with other programs on your computer and will not be responsible for the workings or failures of your equipment, network, software or Internet access.
7. Accounts
Towers of Aghasba is accessible through the PlayStation Store and Steam. You must have an account on each platform where you want to play Towers of Aghasba. You acknowledge and agree that your PlayStation or Steam account is provided and managed by PlayStation or Steam, not by Dreamlit. Your creation and use of those accounts are subject to their applicable terms, conditions, and privacy policies.
Dreamlit may automatically create an Epic Online Services (EOS) account for you if you do not already have a linked account. When joining a multiplayer lobby, your Steam or PlayStation account will operate through a virtual Epic account for online gameplay. Additionally, we may use Epic Online Services for cross-progression features, allowing your progress to be synced across supported platforms.
8. Interruptions, Errors and Downtime
Towers of Aghasba will not be free of errors and your use of the Game may be interrupted from time to time due to software malfunctions, patch updates, upgrades, repairs, power outages, and hackers.
9. Cheating and Fraud
Dreamlit has zero tolerance for cheating and illegal behaviour. At Dreamlit’s discretion, if you are found to:
a) have cheated or attempted to defraud us or any other Towers of Aghasba player in any way.
b) have fraudulent payment or any other fraudulent or illegal activity, Dreamlit reserves the right to suspend or terminate your access to Towers of Aghasba and to share this information with other online gaming providers, banks, credit card companies, and appropriate agencies and authorities.
10. Disclaimers and Limitation of Liability
Towers of Aghasba includes the Unreal® Engine code and other code, materials, and information (the “Epic Materials”) from Epic Games, Inc. (“Epic”). All Epic Materials are provided on an “as is” and “as available” basis, “with all faults” and without warranty of any kind. Dreamlit, Epic, and Epic’s affiliates disclaim all warranties, conditions, common law duties, and representations (express, implied, oral, and written) with respect to Epic’s Materials, including without limitation all express, implied, and statutory warranties and conditions of any kind, such as title, non-interference with your enjoyment, authority, non-infringement, merchantability, fitness or suitability for any purpose (whether or not Epic knows or has reason to know of any such purpose), system integration, accuracy or completeness, results, reasonable care, workmanlike effort, lack of negligence, and lack of viruses, whether alleged to arise under law, by reason of custom or usage in the trade, or by course of dealing. Without limiting the generality of the foregoing, Dreamlit, Epic, and Epic’s affiliates make no warranty that (1) any of the Epic Materials will operate properly, including as integrated in Towers of Aghasba, (2) that the Epic Materials will meet your requirements, (3) that the operation of the Epic Materials will be uninterrupted, bug free, or error free in any or all circumstances, (4) that any defects in the Epic Materials can or will be corrected, (5) that the Epic Materials are or will be in compliance with a platform manufacturer’s rules or requirements, or (6) that a platform manufacturer has approved or will approve Towers of Aghasba, or will not revoke approval of Towers of Aghasba for any or no reason. Any warranty against infringement that may be provided in Section 2-312 of the Uniform Commercial Code or in any other comparable statute is expressly disclaimed by Dreamlit and Epic. Dreamlit, Epic, and Epic’s affiliates do not guarantee continuous, error-free, virus-free, or secure operation of or access to the Epic Materials. This paragraph will apply to the maximum extent permitted by applicable law.
To the maximum extent permitted by applicable law, neither Dreamlit, Epic, Epic’s licensors, nor its or their affiliates, nor any of Dreamlit’s or Epic’s service providers, shall be liable in any way for loss or damage of any kind resulting from the use or inability to use the Epic Materials or otherwise in connection with this Agreement, including but not limited to loss of goodwill, work stoppage, computer failure, or malfunction, or any and all other commercial damages or losses. In no event will Dreamlit, Epic, Epic’s licensors, nor its or their affiliates, nor any of Dreamlit’s or Epic’s service providers be liable for any loss of profits or any indirect, incidental, consequential, special, punitive, or exemplary damages, or any other damages arising out of or in connection with this Agreement or the Epic Materials, or the delay or inability to use or lack of functionality of the Epic Materials, even in the event of Dreamlit’s, Epic’s, or Epic’s affiliates’ fault, tort (including negligence), strict liability, indemnity, product liability, breach of contract, breach of warranty, or otherwise and even if Dreamlit, Epic or Epic’s affiliates have been advised of the possibility of such damages. These limitations and exclusions regarding damages apply even if any remedy fails to provide adequate compensation.
Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, the liability of Dreamlit, Epic, Epic’s licensors, its and their affiliates, and any of Dreamlit’s or Epic’s service providers shall be limited to the full extent permitted by law.
11. Indemnity
You agree to indemnify and hold harmless Dreamlit Inc., along with its directors, officers, employees, contractors, and representatives, from any damages, injuries, liabilities, costs, expenses, or legal fees that may arise as a result of your use of the Game or any breach of this Agreement.
12. Jurisdiction and Legal Limitations
Some jurisdictions may not allow certain exclusions or limitations of liability. In such cases, the disclaimers, exclusions, and limitations outlined in this Agreement will apply to the maximum extent allowed by the laws of the relevant jurisdiction.
Towers of Aghasba is developed and maintained from The United States, and Dreamlit makes no guarantees that the Game is suitable or available for use in any specific region. By choosing to access and use the Game, you do so voluntarily and at your own risk, and you are solely responsible for complying with all applicable local laws, rules, and regulations.
13. Termination of Agreement
Dreamlit reserves the right to terminate this Agreement and your access to the Game immediately if you violate any terms of this Agreement, without affecting any other rights Dreamlit may have under law or equity.
14. Governing Law and Disputes
This Agreement will be governed by and interpreted according to the laws of the State of California, U.S., without reference to its conflict of law principles. You agree to the exclusive jurisdiction of the courts located in California, U.S., for any disputes arising under this Agreement. However, Dreamlit reserves the right to seek interim protection or equitable relief, such as a temporary or interim injunction, from any court with appropriate authority.
15. Changes to Agreement
Dreamlit reserves the right to update this Agreement at any time. If changes are made, you will be notified by being presented with the revised Agreement when you next access the Game. Dreamlit may also choose to provide additional notice at its discretion. By continuing to use the Game after receiving notice of any changes, you agree to accept those changes. If you do not agree with the updated terms, your only option is to stop using the Game.
16. Changes to Game
Dreamlit may, at its sole discretion, add, remove, or modify features of the Game at any time without prior notice. Updates may be required for continued access and use of the Game, and by using the Game, you consent to Dreamlit remotely installing such updates on your computer without additional notification.
The Game software may include additional software and content that you are not licensed to use ("Unsubscribed Software"). You agree that Dreamlit may install this Unsubscribed Software on your device during the Game installation. Until you receive a license from Dreamlit, you are not permitted to access, use, distribute, copy, display, reverse engineer, modify, disassemble, or decompile any Unsubscribed Software.
17. Export Controls
Towers of Aghasba is subject to applicable export laws and regulations. It cannot be re-exported, downloaded, or otherwise transferred to (or accessed by) individuals or entities in countries under embargo by Canada or the United States, or to those listed on any government-maintained control lists. By using Towers of Aghasba, you confirm that you are not located in, under the control of, or a national or resident of any such restricted country or listed entity.
18. General
Waiver: No waiver, delay, or failure to act by Dreamlit regarding any specific default or omission will affect Dreamlit’s rights or remedies concerning that or any future default or omission that has not been expressly waived in writing.
Entire Agreement: This Agreement replaces all prior agreements between the parties concerning the subject matter of this Agreement and constitutes the complete agreement regarding that subject matter.
Assignment and Sublicensing: You may not assign or sublicense this Agreement or any of your rights under it without Dreamlit's prior written consent, which may be withheld at Dreamlit’s discretion.
Binding Effect: This Agreement will benefit and bind the parties, along with their heirs, legal representatives, lawful successors, and permitted assigns.
Uncontrollable Events: Neither party will be liable for any non-performance or delay in performance (except for payment obligations) due wholly or in part to circumstances beyond that party's reasonable control.
