END USER LICENCE AGREEMENT
This Copy of ArcheBlade (“the Software Product”) and accompanying documentation is licensed and not sold. This Software Product is protected by copyright laws and treaties, as well as laws and treaties related to other forms of intellectual property. Codebrush Games or its subsidiaries, affiliates, and suppliers (collectively “Codebrush Games”) own intellectual property rights in the Software Product. The Licensee’s (“you” or “your”) license to download, use, copy, or change the Software Product is subject to these rights and to all the terms and conditions of this End User License Agreement (‘Agreement”)
1.ACCEPTANCE
YOU ACCEPT AND AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT BY SELECTING THE “ACCEPT” OPTION AND DOWNLOADING THE SOFTWARE PRODUCT OR BY INSTALLING, USING, OR COPYING THE SOFTWARE PRODUCT. YOU MUST AGREE TO ALL OF THE TERMS OF THIS AGREEMENT BEFORE YOU WILL BE ALLOWED TO DOWNLOAD THE SOFTWARE PRODUCT. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, YOU MUST SELECT “DECLINE” AND YOU MUST NOT INSTALL, USE, OR COPY THE SOFTWARE PRODUCT.
2.RESTRICTIONS ON TRANSFER
Without first obtaining the express written consent of Codebrush Games, you may not assign your rights and obligations under this Agreement, or redistribute, encumber, sell, rent, lease, sublicense, or otherwise transfer your rights to the Software Product.
3.RESTRICTION ON USE
You may not decompile, reverse-engineer, disassemble, or otherwise attempt to derive the source code for the Software Product.
You may not use the database portion of the Software Product in connection with any software other than the Software Product.
4.RESTRICTIONS ON ALTERATION
You may not modify the Software Product or create any derivative work of the Software Product or its accompanying documentation. Derivative works include but are not limited to translations. You may not alter any files or libraries in any portion of the Software Product. You may not reproduce the database portion or create any tables or reports relating to the database portion. You may not use cheats, automation software (bots), hacks, mods or any other unauthorized third-party software designed to modify the experience of the Software Product.
5.RESTRICTIONS ON COPYING
You may not copy any part of the Software Product except to the extent that licensed use inherently demands the creation of a temporary copy stored in computer memory and not permanently affixed on storage medium. You may make one archival copy which must be stored on a medium other than a computer hard drive.
6.PROPRIETARY RIGHTS; COPYRIGHTS AND TRADEMARKS
A. All title, ownership rights and intellectual property rights in and to the Software Product and all copies thereof (including without limitation any titles, computer code, themes, objects, characters, character names, stories, dialog, catch phrases, locations, concepts, artwork, character inventories, structural or landscape designs, animations, sounds, musical compositions and recordings, audio-visual effects, storylines, character likenesses, methods of operation, moral rights, and any related documentation) are owned or licensed by Codebrush Games. The Software Product is protected by the copyright laws of all countries, international copyright treaties and conventions, and other laws. All rights are asserted and reserved. The Software Product may contain materials licensed by third parties, and the licensors of those materials may enforce their rights in the event of any violation of this License Agreement. All trademarks are the property of their respective owners.
B. ArcheBlade and Codebrush Games are trademarks of Codebrush Games, and all rights, title and interests in and to any and all such marks are hereby expressly reserved by Codebrush Games. All other trademarks, service marks, trade names and logos that appear within Codebrush Games’ games or are displayed on the Codebrush Games’ websites are the property of their respective owners. The Software Product and all materials, information and data contained or displayed within the games, and/or otherwise appearing within the Codebrush Games’ websites, including documents, services, site design, text, graphics, logos, images and icons, as well as the arrangement thereof, are the sole property of Codebrush Games. All rights that have not been expressly granted to you pursuant to these terms are hereby expressly reserved by Codebrush Games. Except as otherwise expressly permitted by applicable law, any reproduction, distribution, modification, retransmission, publication, or other use or exploitation of the games, the website and/or any of the materials (or any portion or derivative of any such items), directly or indirectly, is strictly prohibited unless the written consent of the applicable copyright owner or relevant sublicensor (if any) is first obtained.
7.PATCHES AND UPDATES
Codebrush Games may deploy or provide patches, updates and modifications to the Software Product that must be installed for the user to continue to play the Software Product. Codebrush Games may update the Software Product remotely including without limitation the game client residing on the user’s machine, without the knowledge of the user, and you hereby grant to Codebrush Games your consent to deploy and apply such patches, updates and modifications.
8.ACCOUNT SUSPENSION
Violations of these rules can lead to the following sanctions:
1.Temporary suspension from ArcheBlade Steam Community Hub.
2.Permanent suspension from ArcheBlade Steam Community Hub.
3.Temporary suspension of user account from the Software Product.
4.Permanent suspension of user account from the Software Product.
Prohibited Uses
A.By involving yourself in the Software Product, you acknowledge that you agree to these and all other relevant rules and will abide by them regardless of the circumstances. In addition you also agree that these rules will apply to anyone that you allow to use your Steam account or Steam ID. By allowing another user to use your account, you are personally responsible for all the consequences (including termination of your account).
B.You agree not to do any of the following while using the Software Product or any in-game chat, ArcheBlade Steam Community Hub message boards, messenger-type and other communication features:
Impersonate any person or entity, including but not limited to, the Software Product or other Codebrush Games official, employee, representative or agent (or an official, employee, representative or agent of Codebrush Games’ affiliates, licensors or licensees), forum leader, guide or host or falsely state or otherwise misrepresent your affiliation with a person or entity;
Transmit or facilitate the transmission of any user content that is unlawful, harmful, rude, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, that may be invasive of another’s right of privacy or publicity, hateful, racially, ethnically or otherwise objectionable ;
Transmit any user content to a Codebrush Games communication feature which discloses your or any other person’s personal information;
Transmit or facilitate the transmission of any content to an e-mail address, messenger-feature address or other location that is not yours or to which you do not have the expressly authorized right to use without securing the prior authorization of such other person or entity;
Transmit unsolicited advertising, promotional materials, or other forms of solicitation. Advertising may include, but is not limited to, the repeated posting of website links through any of the in-game methods of communication. Links to sites, images and/or video as well as businesses and organizations or websites not related to Codebrush Games and the Software Product may also be considered as advertising and so such actions are considered prohibited. Discussions of other games of Codebrush Games are allowed, however, any form of advertising of non-Codebrush Games’ games will not be tolerated;
Use cheating and hacking. Any kind of cheating or hacking which is concluded by our assessment of a player’s results will not be tolerated. The hacker’s information will be recorded for future reference and investigation. By using the Software Product you agree to immediately report to Codebrush Games staff on any hacking tools if known that can potentially harm the Software Product for further investigation;
Transmit or facilitate the transmission of any content that contains a virus, corrupted data, trojan horse, bot, keystroke logger, worm, time bomb, cancelbot or other computer programming routines that are intended to and/or actually damage, detrimentally interfere with, surreptitiously intercept or mine, scrape or expropriate any system, data or personal information;
Use Codebrush Games’ communication features in a manner that adversely affects the availability of its resources to other users (e.g., excessive shouting (use of all caps), flooding (continuous posting of repetitive text) or excessively large embedded images, spamming, trolling or flaming);
Discuss social, religious, political topics that create controversy as well as negatively portray religious and political figures.
Discuss controversial issues or actions that violate international law or the law of a player’s country;
Modify any files that Codebrush Games does not specifically authorize users to modify. Use of material, which is subject to the rights of any person or entity without the express permission of such rights holder, is prohibited, and will result in a ban of the account and possible civil and/or criminal liability;
Exploit errors in design, features which are not documented and/or bugs to gain access that would otherwise not be available or to obtain any competitive advantage;
Reverse engineer, decompile or disassemble all or any portion of the Software Product or other services.
D. Reporting Violation
Please report any violations to the above terms and conditions to support@codebrush.net. Attached screenshots and/or video are highly appreciated.
9.DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
UNLESS OTHERWISE EXPLICITLY AGREED TO IN WRITING BY CODEBRUSH GAMES, CODEBRUSH GAMES MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OTHERN THAN AS SET FORTH IN THIS AGREEMENT OR IN THE LIMITED WARRANTY DOCUMENTS PROVIDED WITH THE SOFTWARE PRODUCT.
CODEBRUSH GAMES MAKES NO WARRANTY THAT THE SOFTWARE PRODUCT WILL MEET YOUR REQUIREMENTS OR OPERATE UNDER YOUR SPECIFIC CONDITIONS OF USE. CODEBRUSH GAMES MAKES NO WARRANTY THAT OPERATION OF THE SOFTWARE PRODUCT WILL BE SECURE, ERROR FREE, OR FREE FROM INTERRUPTION.
YOU MUST DETERMINE WHETHER THE SOFTWARE PRODUCT SUFFICIENTLY MEETS YOUR REQUIREMENTS FOR SECURITY AND UNINTERRUPTABILITY. YOU BEAR SOLE RESPONSIBILITY AND ALL LIABILITY FOR ANY LOSS INCURRED DUE TO FAILURE OF THE SOFTWARE PRODUCT TO MEET YOU REQUIREMENTS. CODEBRUSH GAMES WILL NOT, UNDER ANY CIRCUMSTANCES, BE RESPONSIBLE OR LIABLE FOR THE LOSS OF DATA ON ANY COMPUTER OR INFORMATION STORAGE DEVICE.
UNDER NO CIRCUMSTANCES SHALL CODEBRUSH GAMES, ITS DIRECTORS, OFFICERS, EMPLOYEES OR AGENTS BE LIABLE TO YOU OR ANY OTHER PARTY FOR INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND (INCLUDING LOST REVENUES OR PROFITS OR LOSS OF BUSINESS) RESULTING FROM THIS AGREEMENT, OR FROM THE FURNISHING, PERFORMANCE, INSTALLATION, OR USE OF THE SOFTWARE PRODUCT, WHETHER DUE TO A BREACH OF CONTRACT, BREACH OR WARRANTY, OR THE NEGLIGENCE OF CODEBRUSH GAMES OR ANY OTHER PARTY, EVEN IF CODEBRUSH GAMES IS ADVISED BEFOREHAND OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT THAT THE APLICABLE JURISDICTION LIMITS CODEBRUSH GAMES’ ABILITY TO DISCLAIM ANY IMPLIED WARRANTIES, THIS DISCLAIMER SHALL BE EFFECTIVE TO THE MAXIMUM EXTENT PERMITTED.
NEITHER CODEBRUSH GAMES NOR ITS PARENT, SUBSIDIARIES OR AFFILIATES SHALL BE LIABLE IN ANY WAY FOR ANY LOSS OR DAMAGE OF ANY KIND ARISING OUT OF THE SOFTWARE PRODUCT OR ANY USE OF THE SOFTWARE PRODUCT, INCLUDING WITHOUT LIMITATION LOSS OF DATA, LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER DAMAGES OR LOSSES. FURTHER, NEITHER CODEBRUSH GAMES NOR ITS PARENT, SUBSIDIARIES, OR AFFILIATES SHALL BE LIABLE IN ANY WAY FOR ANY LOSS OR DAMAGE TO PLAYER CHARACTERS, VIRTUAL GOODS OR CURRENCY, ACCOUNTS, STATISTICS, OR USER RANKS, OR PROFILE INFORMATION STORED BY THE SOFTWARE PRODUCT AND/OR THE SERVICE. CODEBRUSH GAMES SHALL NOT BE RESPONSIBLE FOR ANY INTERRUPTIONS OF SERVICE, INCLUDING WITHOUT LIMITATION ISP DISRUPTIONS, SOFTWARE OR HARDWARE FAILURES, OR ANY OTHER EVENT WHICH MAY RESULT IN A LOSS OF DATA OR DISRUPTION OF SERVICE. IN NO EVENT WILL CODEBRUSH GAMES BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES.
10.LIMITATION OF REMEDIES AND DAMAGES
Your remedy for a breach of this Agreement or of any warranty included in this Agreement is this correction or replacement of the Software Product. Selection of whether to correct or replace shall be solely at the discretion of Codebrush Games. Codebrush Games reserves the right to substitute a functionally equivalent copy of this Software Product as a replacement.
All warranties cover only defects arising under normal use and do not include malfunctions of failure resulting from misuse, abuse, neglect, alteration, problems with electrical power, acts of nature, unusual temperatures or humidity, improper installation, or damage determined by Codebrush Games to have been caused by you. All limited warranties on the Software Product are granted only to you and are non-transferable. You agree to indemnify and hold Codebrush Games harmless from all claims, judgment, liabilities, expenses, or costs arising from your breach of this Agreement and/or acts or omissions.
11.GOVERNING LAW, JURISDICTION AND COSTS
This Agreement is governed by the laws of the Republic of Korea, without regard to Codebrush Games’ conflict or choice of law provisions.
12.SEVERABILITY
If any provision of this Agreement shall be held to be invalid or unenforceable, the remainder of this Agreement shall remain in full force and effect. To the extent any express or implied restrictions are permitted by applicable laws, these express or implied restrictions shall remain in force and effect to the maximum extent permitted by such applicable laws.

UNDER NO CIRCUMSTANCES SHALL CODEBRUSH GAMES, ITS DIRECTORS, OFFICERS, EMPLOYEES OR AGENTS BE LIABLE TO YOU OR ANY OTHER PARTY FOR INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND (INCLUDING LOST REVENUES OR PROFITS OR LOSS OF BUSINESS) RESULTING FROM THIS AGREEMENT, OR FROM THE FURNISHING, PERFORMANCE, INSTALLATION, OR USE OF THE SOFTWARE PRODUCT, WHETHER DUE TO A BREACH OF CONTRACT, BREACH OR WARRANTY, OR THE NEGLIGENCE OF CODEBRUSH GAMES OR ANY OTHER PARTY, EVEN IF CODEBRUSH GAMES IS ADVISED BEFOREHAND OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT THAT THE APLICABLE JURISDICTION LIMITS CODEBRUSH GAMES’ ABILITY TO DISCLAIM ANY IMPLIED WARRANTIES, THIS DISCLAIMER SHALL BE EFFECTIVE TO THE MAXIMUM EXTENT PERMITTED.
NEITHER CODEBRUSH GAMES NOR ITS PARENT, SUBSIDIARIES OR AFFILIATES SHALL BE LIABLE IN ANY WAY FOR ANY LOSS OR DAMAGE OF ANY KIND ARISING OUT OF THE SOFTWARE PRODUCT OR ANY USE OF THE SOFTWARE PRODUCT, INCLUDING WITHOUT LIMITATION LOSS OF DATA, LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER DAMAGES OR LOSSES. FURTHER, NEITHER CODEBRUSH GAMES NOR ITS PARENT, SUBSIDIARIES, OR AFFILIATES SHALL BE LIABLE IN ANY WAY FOR ANY LOSS OR DAMAGE TO PLAYER CHARACTERS, VIRTUAL GOODS OR CURRENCY, ACCOUNTS, STATISTICS, OR USER RANKS, OR PROFILE INFORMATION STORED BY THE SOFTWARE PRODUCT AND/OR THE SERVICE. CODEBRUSH GAMES SHALL NOT BE RESPONSIBLE FOR ANY INTERRUPTIONS OF SERVICE, INCLUDING WITHOUT LIMITATION ISP DISRUPTIONS, SOFTWARE OR HARDWARE FAILURES, OR ANY OTHER EVENT WHICH MAY RESULT IN A LOSS OF DATA OR DISRUPTION OF SERVICE. IN NO EVENT WILL CODEBRUSH GAMES BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES.
10.LIMITATION OF REMEDIES AND DAMAGES
Your remedy for a breach of this Agreement or of any warranty included in this Agreement is this correction or replacement of the Software Product. Selection of whether to correct or replace shall be solely at the discretion of Codebrush Games. Codebrush Games reserves the right to substitute a functionally equivalent copy of this Software Product as a replacement.
All warranties cover only defects arising under normal use and do not include malfunctions of failure resulting from misuse, abuse, neglect, alteration, problems with electrical power, acts of nature, unusual temperatures or humidity, improper installation, or damage determined by Codebrush Games to have been caused by you. All limited warranties on the Software Product are granted only to you and are non-transferable. You agree to indemnify and hold Codebrush Games harmless from all claims, judgment, liabilities, expenses, or costs arising from your breach of this Agreement and/or acts or omissions.
11.GOVERNING LAW, JURISDICTION AND COSTS
This Agreement is governed by the laws of the Republic of Korea, without regard to Codebrush Games’ conflict or choice of law provisions.
12.SEVERABILITY
If any provision of this Agreement shall be held to be invalid or unenforceable, the remainder of this Agreement shall remain in full force and effect. To the extent any express or implied restrictions are permitted by applicable laws, these express or implied restrictions shall remain in force and effect to the maximum extent permitted by such applicable laws.
