1.1. INTRODUCTION AND AGREEMENT TO THESE TERMS OF SERVICE
By playing our games (the “Games”) or using any of our applications, products or services (collectively, the “Service”), you represent that you have read, understood and agree to be bound by these Terms of Service (the “Terms”) and consent to the collection, use and storage of your information as outlined in Webgames’s Privacy Policy.

1.6. TERMINATION

In the event that we terminate or suspend your account, you will have no further access to your account or anything associated to it. As stated above, you will not be entitled to a refund of any Virtual Currency or Virtual Goods acquired or developed during the Games.

THE SITE, SERVICE, AND GAME, ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND WE DO NOT REPRESENT, WARRANT, OR GUARANTEE THAT THE SITE, SERVICE, OR GAME, WILL BE UNINTERRUPTED, ERROR-FREE, VIRUS-FREE, OR THAT DEFECTS WILL BE CORRECTED. You agree that your access and use of the Site, Service and Games shall be at your sole risk. To the fullest extent permitted by law, Webgames, its officers, directors, employees, and agents disclaim all warranties, express or implied, in connection with the Site, Service and Game and your use thereof, including implied warranties of title, merchantability, fitness for a particular purpose, non-infringement, accuracy, authority, completeness, usefulness, and timeliness. 1.8. LIMITATION OF LIABILITY
Webgames’s aggregate cumulative liability to you arising from or relating to these terms, the site, service, and game, for any cause whatsoever, regardless of the form of the action, will at all times be limited to the total amount you have paid webgames in the twelve (12) months preceding the date of the claim giving rise to the liability.
Under no circumstances will Webgames be liable to you or any third person for any indirect, incidental, special, punitive, or consequential damages whatsoever including any lost profits or lost data arising from your use of the Service, Site or other materials on, accessed through or downloaded from our Service and/or Site, whether based on warranty, contract, tort, any other legal theory, or whether or not Webgames has been advised of the possibility of these damages.
The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction. You specifically acknowledge that Webgames shall not be liable for user submissions or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.
1.9. INTELLECTUAL PROPERTY OWNERSHIP
You acknowledge that all intellectual property rights in our Site, Service, Games and the underlying technology, and all information and content available on our Site and through the Service, excluding User Content (as defined below) but including the Games, characters, Virtual Currency and Virtual Goods (collectively, the “Service Content”), are owned by us and/or our suppliers (including other users).
The Service Content is protected by copyright laws throughout the world. Subject to your compliance with these Terms, Webgames grants you a limited, non-exclusive, non-transferable, non-sublicenseable, revocable license to view and use the Service Content for your personal non-commercial entertainment purposes. No other use of the Service Content is authorized. In consideration of this authorization, you agree that any copy of the Service Content that you make shall retain all copyright and other proprietary notices in the same form and manner as on the original.
You may not otherwise use, download, upload, print, display, perform, reproduce, publish, license, post, transmit, modify, create derivative works of, reverse engineer, disassemble, decompile, adapt, distribute, transfer, or exploit any Service Content in whole or in part without our prior written authorization. We and our suppliers (including other users) reserve all rights not granted in these Terms. There are no implied licenses.
All trademarks, logos and service marks displayed on the Site or Service (“Marks”) are our property or the property of other third parties. You are not permitted to use these Marks without our prior written consent or the consent of such third parties which may own the Marks.
1.10. USER CONTENT
You agree that you are willingly publishing the content on the Service and/or Site using technology and tools provided by Webgames. You understand and agree that you may not distribute, sell, transfer or license this content and/or application in any manner, in any country, or on any social network or other medium without the explicit written permission of Webgames. You grant Webgames the right to act as an agent on your behalf as operator of the application.
Any data, text, graphics, photographs and their selection and arrangement, (hereinafter “User Content”) uploaded to the Service and/or Site are subject, whether in whole or in part, to unlimited commercial, non-commercial and/or promotional use by Webgames. Text, graphics, and photographs are uploaded by you and are the sole responsibility of the person from whom the User Content originated. Thus, users are responsible, and Webgames is not responsible, for any files users upload, post, or otherwise make available. Webgames may or may not regulate User Content and does not guarantee the accuracy, quality, or integrity of any User Content posted via the Webgames application. By using the Service and/or Site, you acknowledge and accept that you may be exposed to material you find offensive or objectionable. You agree that Webgames will not under any circumstances be liable for any User Content, including, but not limited to, errors in any User Content, or any loss or damage incurred by use of the User Content.
1.11. GENERAL
These Terms constitute the entire agreement between you and Webgames regarding your use of our Site, Service, and Games, and supersede and replace any prior written or oral agreements regarding the foregoing. Our failure to exercise or enforce any right or provision in these Terms shall not operate as a waiver of such right or provision. If any provision of the Terms is found to be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from the Terms and shall not affect the validity and enforceability of any remaining provisions. Neither the rights nor obligations arising under these Terms are assignable by you, and any such attempted assignment or transfer shall be void and without effect. Any recommendations or information obtained verbally or in a written form from Webgames or by means of the services, do not inflict on the company any other warranties than those mentioned in the terms of this agreement.
1.12. VIRTUAL CURRENCIES/GOODS
The Service may include the option to purchase virtual, in-game currency (“Virtual Currency”) as well as virtual, in-game goods (“Virtual Goods”) by using legal tender. This can only be done if you are considered a legal adult in your country of residence.
All Virtual Currency and Virtual Goods are deemed to be final and non-refundable, unless stated otherwise at our discretion. You will ave no right or title to any Virtual Goods and/or Virtual Currency you acquire.
Webgames has absolute control over all Virtual Currency and Virtual Goods and at any time has the right to change the value, modify and/or eliminate any Virtual Currency and Virtual Goods as it sees fit and without any liability.
No refunds will be given by Webgames. Other than a limited, revocable, non-transferable license to use the Virtual Currency or Virtual Goods in the Games, you have no right in or title to such Virtual Currency and Virtual Goods. In the event that your account is terminated or suspended for any reason, in Webgames’s sole and absolute discretion, or if Webgames discontinues its Game, you forfeit any and all Virtual Currency and Goods. Webgames has the absolute right to manage, regulate, control, modify, and/or eliminate Virtual Currency and/or Virtual Goods as it sees fit in its sole discretion, and Webgames shall have no liability to you or anyone for the exercise of such rights.
1.13. CONDITIONS FOR PROVISION of the Gaming goods and services
Any additional paid Services in the Game are provided solely by Webgames and the parties specially authorized by Webgames for the provision of paid services.
Obtainment of gaming Services for real money from other third parties may, at the discretion of Webgames, result in a full or partial refusal to provide Services to all Users who participated in the act of purchase and sell.
The list of paid Services is established by the Webgames instruction.
Obtainment of additional paid Services does not exempt you from compliance with and responsibility for non-compliance with the User Agreement, neither does it exempt you from taking towards them any measures bespoken in the User Agreement, including the full or partial refusal from the Service provision. In the event of a refusal to continue with the provision of Services, the compensation for the Services paid is not awarded.
You can obtain additional paid Services of the Game if such Services are paid for; until the confirmation of the payment for additional services is provided, Webgames has a right not to provide such Services, provide them in a limited amount or restrict the obtainment of both, main and additional Services of the Game.
Amount, quality, quantity, price and other characteristics of paid services can change upon the instruction of the Webgames, including the cancellation thereof.
1.14.EFFECTING OF PAYMENTS BY THE USER
You warrant Webgames that you have a right to use the selected means of payment to pay for additional Services, not violating the legislation of the Russian Federation and/or the legislation of the country whose citizen you are. Webgames is not responsible for possible damage caused to third parties and/or other Users of the Game, resulting from your use of the payment means that do not belong to you.
Webgames is not responsible for possible illegal actions of the User regarding the payment for additional Services in the Game. Webgames reserves the right to unilaterally suspend or stop the provision of Services to the User if the User is suspected of committing illegal actions, up until the circumstances are clarified.
Webgames reserves the right to fully stop the provision of any Services to the User who has been found guilty of fraudulence with the means of payment for additional services. At that the User does not get back the money for the Services provided earlier.
Webgames is not responsible for your proper compliance with the terms of payment for the additional Services, as those are beyond the control of Webgames.
All payments regarding the obtainment of monetary units for additional Services of the Game are performed by you via advance payments.
Webgames is not responsible for actions of third parties that resulted in non-transfer (non-receipt) or incomplete transfer (receipt) of monetary funds on the Webgames account.

- engage in any other prohibited conduct.

If you are a citizen of the country the legislation of which prohibits you from obtaining online gaming services or if there are other legal restrictions including the age restrictions on accessing such services, then you are not entitled to use the Game or stand-alone services in the Game, and you are obliged to immediately stop using the Game or such services in the Game.
Upon demand of Webgames you are obliged to disclose true personal information. Any personal information that has been provided to Webgames under collaboration of the Parties to the Agreement, is stored by Webgames solely for the purpose of executing the agreement and under no circumstances can be passed onto the third parties unless for the purpose of executing the agreement or in accordance with requirements of the legislation.
mes reserves the right to decide on the measures against the user suspected of violating the Agreement, even if this user has made a payment (multiple payments) for additional gaming services.
1.6. TERMINATION
We reserve the right to terminate or suspend your account or access to Game at any time and for any reason. It is within our sole discretion and determination to terminate your account for what we deem to be a violation or breach of these Terms. In the event that we terminate or suspend your account, you will have no further access to your account or anything associated to it. As stated above, you will not be entitled to a refund of any Virtual Currency or Virtual Goods acquired or developed during the Games.
1.7. DISCLAIMER OF WARRANTIES
THE SITE, SERVICE, AND GAME, ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND WE DO NOT REPRESENT, WARRANT, OR GUARANTEE THAT THE SITE, SERVICE, OR GAME, WILL BE UNINTERRUPTED, ERROR-FREE, VIRUS-FREE, OR THAT DEFECTS WILL BE CORRECTED. You agree that your access and use of the Site, Service and Games shall be at your sole risk. To the fullest extent permitted by law, Webgames, its officers, directors, employees, and agents disclaim all warranties, express or implied, in connection with the Site, Service and Game and your use thereof, including implied warranties of title, merchantability, fitness for a particular purpose, non-infringement, accuracy, authority, completeness, usefulness, and timeliness. Webgames makes no warranties or representations about the accuracy or completeness of the content of the Service or the content of any sites linked to the Service and/or Site and assumes no liability or responsibility for any:
- errors, mistakes, or inaccuracies of content;
- personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the Service, Site or Game;
- any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein;
- any interruption or cessation of transmission to or from the Service;
- any bugs, viruses, trojan horses, or the like which may be transmitted to or through the Service or Site by any third party;
- any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the Service and/or Site.
- You should also fully acknowledge and confirm that Webgames does not bear any responsibility for any direct, consequential, accidental, special, incidental or punitive damage, including, among others, lost profit, damage of use, loss of data or any other nonmaterial losses, damage to reputation and other damage (even if Webgames was informed about the possibility of such a damage), resulting from:
- The use or the inability to use the services;
Unauthorized access to your data or changes to the data transferred by you or those stored at the server;
Claims or behaviour of any person at the service space;
Any other case related to the services provided.
1.8. LIMITATION OF LIABILITY
Webgames’s aggregate cumulative liability to you arising from or relating to these terms, the site, service, and game, for any cause whatsoever, regardless of the form of the action, will at all times be limited to the total amount you have paid webgames in the twelve (12) months preceding the date of the claim giving rise to the liability.
Under no circumstances will Webgames be liable to you or any third person for any indirect, incidental, special, punitive, or consequential damages whatsoever including any lost profits or lost data arising from your use of the Service, Site or other materials on, accessed through or downloaded from our Service and/or Site, whether based on warranty, contract, tort, any other legal theory, or whether or not Webgames has been advised of the possibility of these damages.
The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction. You specifically acknowledge that Webgames shall not be liable for user submissions or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.
1.9. INTELLECTUAL PROPERTY OWNERSHIP
You acknowledge that all intellectual property rights in our Site, Service, Games and the underlying technology, and all information and content available on our Site and through the Service, excluding User Content (as defined below) but including the Games, characters, Virtual Currency and Virtual Goods (collectively, the “Service Content”), are owned by us and/or our suppliers (including other users).
The Service Content is protected by copyright laws throughout the world. Subject to your compliance with these Terms, Webgames grants you a limited, non-exclusive, non-transferable, non-sublicenseable, revocable license to view and use the Service Content for your personal non-commercial entertainment purposes. No other use of the Service Content is authorized. In consideration of this authorization, you agree that any copy of the Service Content that you make shall retain all copyright and other proprietary notices in the same form and manner as on the original.
You may not otherwise use, download, upload, print, display, perform, reproduce, publish, license, post, transmit, modify, create derivative works of, reverse engineer, disassemble, decompile, adapt, distribute, transfer, or exploit any Service Content in whole or in part without our prior written authorization. We and our suppliers (including other users) reserve all rights not granted in these Terms. There are no implied licenses.
All trademarks, logos and service marks displayed on the Site or Service (“Marks”) are our property or the property of other third parties. You are not permitted to use these Marks without our prior written consent or the consent of such third parties which may own the Marks.
1.10. USER CONTENT
You agree that you are willingly publishing the content on the Service and/or Site using technology and tools provided by Webgames. You understand and agree that you may not distribute, sell, transfer or license this content and/or application in any manner, in any country, or on any social network or other medium without the explicit written permission of Webgames. You grant Webgames the right to act as an agent on your behalf as operator of the application.
Any data, text, graphics, photographs and their selection and arrangement, (hereinafter “User Content”) uploaded to the Service and/or Site are subject, whether in whole or in part, to unlimited commercial, non-commercial and/or promotional use by Webgames. Text, graphics, and photographs are uploaded by you and are the sole responsibility of the person from whom the User Content originated. Thus, users are responsible, and Webgames is not responsible, for any files users upload, post, or otherwise make available. Webgames may or may not regulate User Content and does not guarantee the accuracy, quality, or integrity of any User Content posted via the Webgames application. By using the Service and/or Site, you acknowledge and accept that you may be exposed to material you find offensive or objectionable. You agree that Webgames will not under any circumstances be liable for any User Content, including, but not limited to, errors in any User Content, or any loss or damage incurred by use of the User Content.
1.11. GENERAL
These Terms constitute the entire agreement between you and Webgames regarding your use of our Site, Service, and Games, and supersede and replace any prior written or oral agreements regarding the foregoing. Our failure to exercise or enforce any right or provision in these Terms shall not operate as a waiver of such right or provision. If any provision of the Terms is found to be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from the Terms and shall not affect the validity and enforceability of any remaining provisions. Neither the rights nor obligations arising under these Terms are assignable by you, and any such attempted assignment or transfer shall be void and without effect. We may assign these Terms without restriction. These Terms and any action related to these Terms will be governed by and interpreted under the laws of Russian Federation.
Any recommendations or information obtained verbally or in a written form from Webgames or by means of the services, do not inflict on the company any other warranties than those mentioned in the terms of this agreement.
1.12. VIRTUAL CURRENCIES/GOODS
The Service may include the option to purchase virtual, in-game currency (“Virtual Currency”) as well as virtual, in-game goods (“Virtual Goods”) by using legal tender. This can only be done if you are considered a legal adult in your country of residence.
All Virtual Currency and Virtual Goods are deemed to be final and non-refundable, unless stated otherwise at our discretion. You will ave no right or title to any Virtual Goods and/or Virtual Currency you acquire.
Webgames has absolute control over all Virtual Currency and Virtual Goods and at any time has the right to change the value, modify and/or eliminate any Virtual Currency and Virtual Goods as it sees fit and without any liability.
No refunds will be given by Webgames. Other than a limited, revocable, non-transferable license to use the Virtual Currency or Virtual Goods in the Games, you have no right in or title to such Virtual Currency and Virtual Goods. In the event that your account is terminated or suspended for any reason, in Webgames’s sole and absolute discretion, or if Webgames discontinues its Game, you forfeit any and all Virtual Currency and Goods. Webgames has the absolute right to manage, regulate, control, modify, and/or eliminate Virtual Currency and/or Virtual Goods as it sees fit in its sole discretion, and Webgames shall have no liability to you or anyone for the exercise of such rights.
1.13. CONDITIONS FOR PROVISION of the Gaming goods and services
Any additional paid Services in the Game are provided solely by Webgames and the parties specially authorized by Webgames for the provision of paid services.
Obtainment of gaming Services for real money from other third parties may, at the discretion of Webgames, result in a full or partial refusal to provide Services to all Users who participated in the act of purchase and sell.
The list of paid Services is established by the Webgames instruction.
Obtainment of additional paid Services does not exempt you from compliance with and responsibility for non-compliance with the User Agreement, neither does it exempt you from taking towards them any measures bespoken in the User Agreement, including the full or partial refusal from the Service provision. In the event of a refusal to continue with the provision of Services, the compensation for the Services paid is not awarded.
You can obtain additional paid Services of the Game if such Services are paid for; until the confirmation of the payment for additional services is provided, Webgames has a right not to provide such Services, provide them in a limited amount or restrict the obtainment of both, main and additional Services of the Game.
Amount, quality, quantity, price and other characteristics of paid services can change upon the instruction of the Webgames, including the cancellation thereof.
1.14.EFFECTING OF PAYMENTS BY THE USER
You warrant Webgames that you have a right to use the selected means of payment to pay for additional Services, not violating the legislation of the Russian Federation and/or the legislation of the country whose citizen you are. Webgames is not responsible for possible damage caused to third parties and/or other Users of the Game, resulting from your use of the payment means that do not belong to you.
Webgames is not responsible for possible illegal actions of the User regarding the payment for additional Services in the Game. Webgames reserves the right to unilaterally suspend or stop the provision of Services to the User if the User is suspected of committing illegal actions, up until the circumstances are clarified.
Webgames reserves the right to fully stop the provision of any Services to the User who has been found guilty of fraudulence with the means of payment for additional services. At that the User does not get back the money for the Services provided earlier.
Webgames is not responsible for your proper compliance with the terms of payment for the additional Services, as those are beyond the control of Webgames.
All payments regarding the obtainment of monetary units for additional Services of the Game are performed by you via advance payments.
Webgames is not responsible for actions of third parties that resulted in non-transfer (non-receipt) or incomplete transfer (receipt) of monetary funds on the Webgames account.
2. PRIVACY POLICY
Webgames (“Webgames” or “we”) is dedicated to protecting the privacy rights of our online users (“users” or “you”). Content in Webgames applications may be hosted by other websites or applications. Any personal information you provide on the linked pages or applications is provided directly to that third party and is subject to that third party’s privacy policy, not ours. 2.7. POLICY REGARDING CHILDREN UNDER THE AGE OF 16

3. CHAT RULES
These rules extend to all players who participate in the game's chat. Abiding by the rules is mandatory for all users. Breaking these rules may lead to the user being banned from chatting or to the user's account being blocked from playing the game.
In the in-game chat:
- Advertising is forbidden.
- Repeating identical messages many times (flooding) is forbidden.
- Abusing capslock is forbidden; this includes writing messages with alternating caps (for example: hEy ThErE, HoW aRe yOu?)
- Sending any messages containing any personal information without the authorization of the information's owner is forbidden.
- Sending messages containing direct or indirect threats of violence, blackmail or extortion in real life is forbidden. Offensive messages in any form, breaches of human dignity or any words or phrases that discredit the honor and dignity of other users are not allowed.
- Swearing or using veiled swear words (euphemisms, unfinished words, acronyms, words with one or more letters replaced, words with asterixes etc.) in any language or any encoding is forbidden.
- It is forbidden to discriminate by race, nationality, religion or any other identifying attribute; publish nationalistic appeals or statements; send messages calling for any kind of action or actions against other nationalities or peoples; send messages that speak proudly of the superiority of one nation or people over another.
- It is forbidden to send messages containing propaganda of violence or weapons; openly discuss any narcotic substances; send messages containing propaganda of alcoholic beverages and tobacco products; send messages of a sexual/pornographic character, including text smileys of an atanomical character.
- Discussing contemporary politics is not allowed, as this is known to cause conflict.
- Knowingly publishing incorrect information about the game, its administration or its users is forbidden.
In this game, you are not allowed to use nicknames which: - Directly or indirectly relate to organizations or to historical and political figures who have been judged by an international tribunal for crimes against humanity and, accordingly, cause a negative reaction in most people. Nicknames containing the names of terrorists or terrorist organizations, including currently active ones, are also not allowed.
- Contain a reference to racial or nationalistic superiority or encourage discrimination on any level.
- Are related to pedophilia, disability or the results of extortion directly or indirectly related to a sexual act or violence.
- Contain information which may cause the user to be mistakenly viewed as a member of the administration team.
4. MODIFICATION OF THE AGREEMENT
Webgames can modify this Agreement without any prior warning by publishing the final version of the Agreement in the Game Resources.
You can keep on using the Product if you accept the terms of the new version of the Agreement.
You are obliged to check for modifications to the Agreement no less than once per seven days. In case you do not make such a check within the speified time frame or if after reading the Agreement (a new edition of the Agreement) you keep on using the Services, it is considered that you are aware of and in agreement to the Agreement (a new edition of the Agreement).
5. DISPUTES BETWEEN USERS
Webgames may at any time intervene in disputes between you and other users, but is under no obligation to do so. Webgames will not be liable for anything resulting from these disputes, including, but not limited to, claims and damages, of any kind.
